Toys Quality Order Becomes Effective in India

Department for promotion industry and internal trade (DPIIT) of the Ministry of Commerce and Industry of India issued the Toys (Quality Control) Order, 2020 on February 26, 2020.

This Quality Control Order applies to Toys used in play by children under 14 years. It specifies 7 standards for different categories of toys that should be used for the conformity assessment procedure. This Order is applicable to manufacturers who produce domestic toys as well to the Importers who ship toys from outside the country.


The Order was supposed to become effective from September 1, 2020. However, the implementation period was extended up to January 1, 2021.


Thus, starting from January 2021, it will be necessary to obtain a BIS license for toys and affix the Standard Mark thereafter to get access to the Indian market.


Although there are 7 standards in the Order, the BIS uses only two primary standards that allow dividing toys into two classes as per Scheme-I of Schedule-II of BIS (Conformity Assessment) Regulations, 2018.


BIS classified toys into the following 2 types:


- Non-Electric Toys

- Electric Toys (which have at least one function dependent on power source)


So, if you have a non-electric toy and want to apply for the BIS license, your product must meet the requirements of IS 9873 (Part 1): 2019. If the toy is powered by an electrical source, the requirements of IS 15644:2006 must be met.


Please note that if your product also falls under the requirements of the secondary standards indicated in the Order, it will be tested not only against the primary standard requirements but also applicable secondary standards ones.
